Real Results*

Multi-Claim Defense

Protected the interests of a testing laboratory against a 34-cause-of-action case brought by a former shareholder and employee. Successfully resolved the case by a court judgment after bench trial that rejected all claims by the plaintiff except for the buyout of shares at the agreed price in the Buy-Sell Agreement and repayment of a loan — a result that was less favorable to the plaintiff than the outcome for which we and our client had tried to negotiate for years but was rejected by the plaintiff. The case is currently on appeal.

Jury Trial Victory for Employer

Defended a health-care-service company against a multiple claim employment lawsuit alleging, among other things, pregnancy discrimination and wrongful termination, and seeking more than $650,000. Obtained a complete defense verdict and judgment after a three-week jury trial.

Trial to Bankruptcy Win

Provided vigorous defense for an auto repair company facing a breach of lease case brought by a commercial lessor. Obtained a complete defense judgment after a bench trial plus an award of all attorneys’ fees and costs incurred by our client during the case. Successfully defended an appeal of that judgment, which was affirmed by the Court of Appeal. Asserted the judgment creditor claim for attorneys’ fees and costs award when the commercial lessor filed for Chapter 11 bankruptcy. Recovered payment in full for all attorneys’ fees and costs incurred during the underlying case, the appeal and the bankruptcy case through the Chapter 11 bankruptcy plan. Successfully navigated the interplay between the Chapter 11 bankruptcy case and the pending state court case and appeal.

18-Claim Defense Win

Defended a dental corporation in an 18-cause-of-action case brought by a former employee and obtained a complete defense judgment on all claims after a bench trial. The case is currently on appeal.
